Supreme Court Denies Class-action Against Halifax Dentist

A class-action bid by former patients of a Halifax pediatric dentist has been denied by Nova Scotia Supreme Court.

The legal action against Dr. Errol Gaum involved his alleged victims who hoped to receive compensation for the assault and negligence that Gaum had used on them while practising from the early 1970s to 2020. The plaintiffs were children at the time and some of the techniques Gaum allegedly used on them included holding a hand over their mouth and nose, hitting, using body restraints, saying threats and more.

The lawyer representing 300 former patients, Jamie MacGillivray, now needs to decide “whether to appeal the decision or proceed as a mass tort where everybody is considered an individual claimant, but they’re all on one claim,” reports Saltwire.
